Court of Protection
We can assist with an application to Court for a Deputy if someone has lost capacity, but has not appointed an Attorney to administer their affairs for them.
Obtaining Probate
When a loved one dies, there can often be a lot of work to do to administer their estate. We can assist with this as well as advise on the related trusts moving forward. We can tailor the service to suit your needs whether that means dealing entirely with the estate or guiding you through the process and assisting with the preparation of the Inheritance Tax forms and the Oath to obtain the Grant.
We also advise on Deeds of Variation and obtaining the Grant of Probate or Letters of Administration. We prepare estate accounts on behalf of the executors and tax returns.
Fees for this service can either be an hourly rate or percentage based with a lower hourly rate
Estate Administration
We can assist in administering the estate of a loved one when they have passed away. We can adapt our service to suit your needs, whether that means dealing with the entirety of the estate, or guiding you through the process and assisting with the preparation of the tax forms and the oath to obtain the relevant grant.
Will Preparation
We advise on estate planning and preparing wills that are tax efficient whilst ensuring that your estate passes to those whom you intend whether that is outright or on trust. This will involve detailed questions concerning your family and your intentions as to who you would like to benefit from your estate and how.
Whilst we do not prepare wills for overseas assets, we will advise on the interaction between your UK will and Wills for assets that are situated abroad.
We will also review life policies and pension scheme and death in service benefits to ensure tax efficiency.
We will advise on the duties of executors and trustees so the appropriate appointments can be made.
Fees for this service are usually fixed.
Intestacy
60% of people die without a will. We can advise on the intestacy provisions and administer estates in accordance with the rules thereof.
Trusts
We can advise and prepare lifetime trusts and deal with the reporting thereof to HM Revenue & Customs.
Power of Attorney
We advise on and can prepare Property and Affairs and Health and Welfare Lasting Powers of Attorney as well as General and Trustee Powers of Attorney. We can also assist with Living Wills and Advance Directives.
