The residential property practice is headed by Partner Ian Hay who deals with all Sale and Purchase scenarios and associated matters.

Ian is assisted by an experienced conveyancing team who works extensively with both local and other property professionals throughout London South East England region.

Areas within Residential Property

Licence for Alteration

If you own a lease hold property and wish to carry out any works you will need the consent of the Landlord and legal documentation reflecting what has been agreed. We have dealt with many of these and are able to assist where required.

Deed of Variation

We can assist in amending the terms of the lease and other variations to the title documentation.

Buying & Selling Houses & Flats

If you are thinking of selling your house or flat we are happy to advise and assist.

Prior to putting your property on the market, or as soon as possible after doing so, we can provide you with general advice on the transaction and in preparing the paperwork so that everything is ready to go once a buyer is found.

We will then prepare all of the documentation and submit it to the buyers solicitors, guiding you through the process until your sale is successfully concluded.

Likewise, if you are buying a house or flat, we will assist you through the entire process – whether you are a first time buyer or you have moved several times before.

Obvioulsy many of you will be selling and buying at the same time and we will again guide you through the process, advising all of the in’s and out’s to make sure everything goes through smoothly and at the same time.

Buying and Selling Freeholds & Leaseholds

We are experienced in both Freehold and Leasehold property matters and so are happy to explain and guide you through the process of each.

Freeholds tend to be house’s while Leaseholds are normally flats.

There are also Freeholds of flats which can be confusing to many people and we are of course happy to explain these and again guide you through the process. If you are buying a Leasehold flat you sometimes also purchase a share of the Freehold and this can be done by a share in the Freehold Company or actually jointly owning with other flat owners in your own names.

New Builds and Developments

We have acted for a number of new developments advising and preparing documentation for the developers or indeed advising purchasers in connection with buying a property on a new development.

Should you therefore be a developer we would be happy to advise you on the setting up of the documentation in a sale of the plots or flats.

Should you be interested in buying on a new development we can advise you of the process from the outset, whether the development is finished or whether you are buying off plan.

Mortgages & Remortgages

As a memeber of the Law Society Conveyancing Quality Scheme we are on all the major mortgage lenders panels and so can act and assist you in mortgage and re mortgage requirements.

Buy to Let

Granting Leases

We are experienced in the grant of leases whether they be long residential leases or short rental leases.

We have acted on a number of new developments where a number of leases are granted at the same time and have also acted on the grant of individual leases with relation to both small and large freehold properties.

Forfeiture of Leases

If you are being threatened with forfeiture of your lease we can assist you by advising you of your rights and also in combating the forfeiture proceedings.

Shared Ownership

If you are buying in joint names we can advise you on whether you should be registered as joint tenants or tenants in common and also whether you need to take out a trust deed to assist you with detailing your respective shares and responsibilities in connection with the property.

Right to Buy

We have acted for many clients in connection with their right to buy of local authorities and should you require any advice in this connection please do not hesitate to contact us.

The transaction can seem daunting to start with but we feel once explained should be easy to understand.

Help to Buy

The Help to Buy scheme was introduced by the Government to assist first time buyers in getting on the property ladder.

We have acted in Help to Buy property purchases in the past and are happy to assist you with any questions or queries you might have in this connection.

Boundary Issues

If you are not sure where your boundary is or the extent of your garden or property we can assist you with this or indeed if you have a dispute with one of your neighbours regarding the same.

Likewise we can advise you on Party Wall matters should you be intending to build, or your neighbour build, on a Party or shared wall.

Freehold Enfranchisement

If you are a Leaseholder on a long residential lease and the majority of the other Leaseholders wish to purchase the Freehold from the existing Freeholder we can guide and assist you in this.

Likewise if you are a Freeholder and your tenants are wishing to purchase the Freehold from you under the Enfranchisement legislation or otherwise we can assist you in how to proceed.

Disputes

We can help with certain property disputes, whether they be boundary disputes, Landlord and Tenant disputes or otherwise.

Lease Advice

We are happy to advice you on the contents on your lease whether this be a long residential lease or an assured short hold tenancy or titled lease.

This advice can extend to what you are and not allowed to do, whether you are allowed to rent out, whether to you are allowed to carry out alterations and exactly what your rights and obligations are.

Conveyancing

We can help with all your conveyancing needs whether it is selling your house or flat or purchasing the same whether you are a first time buyer or moving house again.

In addition for acting for private individuals we also act for companies and property developers and mortgage companies.

We are fully conversant with acting in a sale or purchase of freehold houses, leasehold flats, large developments and all associated matters.

We have obtained the prestigious conveyancing quality standard with the Law Society and are on the majority of lending panels.
